Live Event Terms & Conditions

1. Definitions

In this document, unless the context otherwise requires, the following words have the following meaning:

Business Mastery: means Business Mastery Pty Ltd (ABN 71 099 095 128), its successors and assigns and their Associated Entities as that term is defined in the Corporations Act 2001 (Cth).

Event means: the summit held by Business Mastery on the Event Date.

Event Date: means the date specified in your order confirmation and/or ticket. 

You or Your: means the purchaser and/or the person named on the order confirmation and/or ticket to the Event jointly and severally.

2. Prices are in Australian Dollars

2.1 All published tickets prices and other fees are in Australian Dollars (AUD). You are responsible for any international transaction charges and foreign currency exchange costs associated with any purchase from Business Mastery.

3. The Event

3.1 Business Mastery will host the Event on the Event Date.

3.2 You acknowledge that the published Event Date and time is in Australian Eastern Standard Time or Australian Eastern Summer Time; whichever is applicable in the State of New South Wales, Australia on the day of the Event.

4. Transfer

4.1 If you do not attend the Event on the Event Date then you will not be entitled to a refund, any relief from a payment plan or to attend the Event at a later date.

4.2 You may transfer your ticket to another person by providing Business Mastery written notice at least 5 business days prior to Event Date, including the name, address and contact details for the new ticket holder. Any transfer of your ticket to another person is subject to these terms and conditions.

5. Event Rescheduling

5.1 Business Mastery may make minor changes to the Event, including but not limited to:

(a) the venue(s) (but not cities);
(b) any speaker(s) other than Kerwin Rae; and
(c) session times.

5.2 You agree to accept such minor changes and will have no right to terminate this agreement or bring or commence any claim for a refund of Fees or compensation as a result.

5.3 In the event that a pandemic, epidemic, act of war, natural disaster, government directive, change in law and/or any other fact, matter or circumstance beyond the reasonable control of Business Mastery means that the Event cannot proceed on the Event Date then Business Mastery may:

(a) reschedule the Event, including but not limited to changing the Event Date, venue, speakers, content, duration or any other component of Event; and/or
(b) transfer the Attendee(s) ticket(s) so that they may attend the Event on an alternate Event Date;
(c) alter the form of the Event so that it can proceed, including changing it to a livestream event that is attended remotely over the internet.

5.4 You are not entitled to make a claim for a refund, compensation or reimbursement of any additional expenses arising from any act or decision of Business Mastery under clause 5.3 above.

6. Event Cancellation

6.1 Business Mastery may in its sole and absolute discretion cancel the Event at any time by providing the purchaser or attendees notice in writing.

6.2 If the Event is cancelled Business Mastery will refund any fee paid by the purchaser. You are not entitled to any other refund, compensation or reimbursement of any additional expenses incurred or arising from the cancellation of the Event

7. Filming

7.1 You acknowledge and agree that the Event may be recorded and that Business Mastery shall own any and all recordings in any format and may use any recordings for promotional and marketing purposes.

7.2 You irrevocably authorise Business Mastery to use their voice, materials, name and likeness for promotional and marketing purposes and materials in print, online and/or any other format.

7.3 You will not record, reproduce or re-transmit the Event or any part of it nor will they use the name and likeness of Kerwin Rae, any Business Mastery staff or any other attendees for any purpose.

8. Financial Disclaimer

8.1 All information provided to you or that you have access to, as part of the Event is general information only and has been prepared without considering an individual’s objectives, obligations, or financial situation. Business Mastery does not provide financial, taxation, legal or accounting advice. You must consider your personal and business objectives, financial situation and other personal or business needs or obligations, before taking or refraining from taking any steps based on information or suggestions provided throughout the Event.

9. Right to Refuse Service

9.1 Business Mastery retains the sole and absolute discretion to refuse service and/or entry to the Event, to a person or persons it reasonably believes may be engaging in illegal behaviour or conducting themselves in a way which would potentially bring Business Mastery, its employees, contractors, and/or clients into disrepute, or would unreasonably impact the fair and equitable operation of Business Mastery business practices and/or the running of the Event.

10. Disclaimer

10.1 To the fullest extent permitted by law but subject to the Australian Consumer Law, Business Mastery disclaims and excludes any and all guarantees, undertakings and warranties, representations expressed or implied, and shall not be liable for any loss or damage whatsoever (including human or computer error, negligent or otherwise, by one or more of the authorities, or incidental or consequential loss or damage) arising out of or in connection with any use or reliance on the information or advice provided at the Event, or in any other forum.

11. VIP Priority Seating

11.1 If you have purchased a VIP upgrade then you must arrive at the Event in the published VIP registration period to ensure you receive allocated seating. If you arrive after this period then Business Mastery is not obliged to provide you with an allocated seat.

12. Marketing Messages

12.1 You agree to receive occasional marketing messages from or on behalf of Business Mastery. You will be able to unsubscribe at any time.

13. Assignment and Novation

13.1 Business Mastery may assign or novate this agreement or otherwise deal with the benefit of it or a right under it by written notice to you. You consent to any such assignment, novation or dealing and waive any right to object to it.

14. Governing Law

14.1 This document is governed by and construed in accordance with the laws of New South Wales, Australia.
